Rental Agreement:

These terms and conditions outline the rules and regulations of making reservations and booking directly with Muskoka Vacation House, located in Huntsville, Ontario. 

 

This Vacation Rental Agreement (the Agreement) is made by and between Muskoka Vacation House (Homeowner) and    the Guest (Guest) as of the date last set forth on the reservation/booking statement sent to the Guest. The parties hereby agree as follows:

1. Property:

The homeowner agrees to rent the property to the guest under the terms and conditions set fourth in this agreement. The vacation rental property is located in Huntsville, Ontario. The full address will be sent out to Guest once full payment is made and reservations have been confirmed. The property is fully furnished and includes all amenities and details found on this website. 

2. Rental Party:

The rental party shall consist of Guest and those listed in their party at the time of booking. 

3. Maximum Occupancy:

The maximum number of guests is limited to 6 persons.  The full security deposit will be retained if more than the maximum has stayed overnight on the property without prior consent.

4. Term of the Lease:

The property is a short term rental vacation property and under NO CIRCUMSTANCES is it to be rented or occupied on a long term basis (more than 25 consecutive days) to full time tenants. In renting this property, the Guests fully agree to rent under short term vacation property terms and conditions and will not seek to rent the property for more than 25 consecutive days unless otherwise agreed upon by the homeowners. Guests agree to checkout on their specified checkout day. The vacation rental time frame is listed on the booking confirmation email sent to the guest. Check-in is always as of 4pm and Check-out is always before 10:00am unless otherwise stated or permission given. The property is  popular during the summer months, holidays, log weekends, Fall season and Winter breaks and we must accommodate guests checking in and out on the same day. As such, not adhering to the check-out time will result in an additional late fees being set at $ 250 unless discussed in advance of the stay.

5. Rental Rules:

Guest agrees to abide by the Rental Rules while at the property, and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the rules set fourth in this agreement while residing at the property. These rules are in place so the property can be enjoyed by all guests.

  • No smoking anywhere inside the property
  • No pets on the property, unless permission given prior
  • No food left outdoors, or in rooms…ever
  • All trash placed in the provided areas
  • Do not use Bath towels for beach use, please bring your own beach towels
  • Please returns items, equipment back to its original place
  • Please do your best to leave property in same condition as you found it, within reason.
  • Please clean your dishes, or leave in dishwasher and throw out your trash in the provided bins

 

6. Access to Property:

Guest shall allow Homeowner access to the property for purposes of repair, inspection or emergency. Homeowner shall exercise this right of access in a reasonable manner by giving at least 1-2 hours notice (unless in case of emergency).

 

7. Security Deposit:

The security deposit covers any property damage that occurred during the guest stay. The security deposit is refundable within 7 days of check-out if the property was not damaged in any way. If the guest has caused any damages to the property, they are to mention it to the homeowner as soon as possible. Although accidents do happen, for all the years we have been owners of a short-term rental, our guests have never damaged anything that was not immediately repaired, and we have never used a security deposit to rectify a damage claim.

 

8. Cancelation & Refund Policy:

The property is very popular and booked ahead of time, especially in the summer months, Fall Season, Winter Holiday Season and Holiday weekends throughout the year. As such, we are firm on our cancellation policies. If Guest wishes to cancel the reservation, refunds are as follows.

If we are actually able to fill the dates that you are cancelling with another guest, we will provide you with a FULL refund MINUS the difference in booking rate of that guest if there is one. Example, if we fill for the same rate or higher, 100% refund, if $150 lower, for instance, then refund minus $150). Security deposits are always refunded.

The overall cancellation policy is as follows: (there are some exceptions on a case by case basis):

100% of your payment if canceled within 2 days of BOOKING

  70% of total if canceled 30 to 60 days prior to the Check-in Date (100% of security deposit will be returned)

  50% if canceled 15 to 30 days prior to the Check-in Date (100% of security deposit will be returned)

    0% if canceled within 15 days prior to the Check-in Date (100% of security deposit will be returned)

There are no cancellations or refunds during the guest stay due to natural causes, acts of god or weather. The Homeowner may also be entitled to cancel the Guest stay if house rules are broken during rental period.

 

9. Insurance:

We encourage all guests to purchase traveler cancellation insurance in case of unforeseen circumstances, accidents, trip cancellation or other issues that may prohibit Guest from traveling or fulfilling rental terms.

 

10. 3rd Party Rentals/Sub Lease:

We do NOT accept 3rd party rentals or subleasing. The guest must be the one renting at, staying at and paying for our property.

 

11. Payment:

All directing booking will need to read and sign a rental agreement

All direct bookings will need to provide a picture government ID

All direct bookings will need to provide a $500 security deposit, refunded within 7 days of checkout if there are no claims.

All payments for reservations will be done by etransfer. All details will be sent directly to Guests.

By reserving and staying at our property, you hereby confirm to send funds to homeowner for the amounts stated in the reservation email sent to Guest. You agree that all rental funds adhere to the cancellation policy above.

 

12. Activity Liability Waiver:

You understand that you or any of your guests using any equipment, appliance, fireplace or any other feature of the property, indoor or outdoors at any time are at your own risk and that special risks may be involved with these activities. You understand and acknowledge that there are potential dangers that these activities or other activities on the property may present to children who are not carefully supervised, as well as the danger to any person participating in these activities if a person has health risks or is intoxicated or using any kind of drugs or medication, or while pregnant.

You and your guests agree to follow all Huntsville, Ontario by-laws pertaining to outdoor firepits and noise while using the property. 

You agree to be fully and solely responsible for any accidents or any bodily injury arising from such activities that you or your guests may incur in participating in these activities on our property. You understand the risks discussed above and agree that you will assume all medical, legal and financial responsibility for yourself and for the consequences of those in your party and hold owner/host harmless from medical, legal and financial responsibility.

You agree to waive any claim whatsoever against owner, host or property for accidents or claims arising from any activity on the property.

All Guests in your party acknowledge and agree that they have read and understand this waiver and they acknowledge that renting this property constitutes a binding and enforceable contract of these terms between Guests and Host.

 

13. Picture ID:

For insurance purposes, a copy of a valid government issued picture ID that shows your current address will be required. A driver’s license is the most effective. Instructions will be sent to Guest with the reservation instructions. 

 

All Guests in your party acknowledge and agree that they have read and understand this agreement, including the waiver and they acknowledge that renting this property constitutes a binding and enforceable contract of these terms between Guests and Host.

A full property guide will be sent to Guests that will include all pertinent information and access to the rental property.
